Senator Tom Harkin, Chairman
Senate Committee on Health, Education, Labor and Pensions
731 Hart Senate Office Building
Washington, DC 20510

Dear Senator Harkin:

On behalf of the Alliance for Worker Freedom (AWF), I urge you to call for a full Senate hearing on President Obama’s nominee for Assistant Secretary of Labor for the Occupational Safety and Health Administration (OSHA), Professor David Michaels of the George Washington University School of Public Health.

OSHA has the all-important responsibility of protecting workers and ensuring their work environments are safe and functional. It is fair to request that Michaels’, who will assume a pivotal role in OSHA, history, current views, and direction for the organization be examined.

There is reasonable concern that Michaels’, who has consistently demonized the business community, would seek to over regulate industry. Evidence of this point of view is found in Michaels’ book, Doubt is Their Product, which unfairly attacks companies who doubt the necessity of various regulations by comparing them to tobacco companies. Michaels’ immediate dismissal of any skepticism through personal attacks is disconcerting.

Furthermore, Michaels’ has objected to the Supreme Court’s unanimous Daubert v. Merrell Dow Pharmaceuticals decision in 1993. The Daubert ruling stated that in the court of law, scientific data must meet certain standards in order to be considered as evidence. Daubet was widely held as a great success as it prevented phony claims from clogging up our justice system and false claims from distorting it.

Michaels’ has supported controversial initiatives in a variety of different realms. A closer examination of Michael’s past is necessary to ensure that his positions are known and the direction he wishes to take OSHA is known.

AWF WILL RATE Michaels’ confirmation vote in our annual Congressional Scorecard. A vote for Michaels will negatively affect your contention for the Guardian of Worker Freedom Award.

Sincerely,

Brian M. Johnson, MPA
Executive Director
